California Penal Code 115(a)
(a) Every person who knowingly procures or offers any false or forged instrument to be filed, registered, or recorded in any public office within this state, which instrument, if genuine, might be filed, registered, or recorded under any law of this state or of the United States, is guilty of a felony.
It is a felony in California and every single other state, to file documents into the public record which are fraudulent, i.e., forged, fabricated, untrue, incorrect, with proven notary-fraud and/or "robo-signed." "Public record" means any public repository of official documents such as county's clerk-recorder's office or any court of law. In the latter it's a "fraud upon the court" to file a document purported to have true and correct signatures attesting to the truth of a transaction, and then to have any of the very signatures on the face of that document be proven to be a forgery. That would render the document void. And any legal argument or position which relies on that void document as validation thereof would fail as being also void of merit or truth.
From an article by Kraut Law Group: "Filing a False Document under [CA] Penal Code Section 115 PC is usually associated with other Theft Crimes and White Collar Crimes such as Real Estate Fraud and Mortgage Fraud. In fact, prosecutors may prefer to file charges under Penal Code 115 PC because it is a felony level offense that is easier to prove than some of the more complex fraud charges. Its a deplorable despicable practice, really, but all-too-common in the paperwork we see across the country in all fifty states, being used to foreclose and dispossess people of their homes.
